Missed Your ITR Deadline? Last Date for Belated Return Is 31 December 2026

Updated: 27 October 2026

If you have not filed your Income Tax Return (ITR) for Assessment Year 2026–27, there may still be time to complete it. The Income Tax Department allows eligible taxpayers to file a belated return up to 31 December 2026, or before completion of the assessment, whichever occurs earlier.

Missing the original deadline does not mean you should ignore your tax filing. Filing promptly can help you meet your remaining compliance obligations and avoid further complications.

1. What is the last date to file a belated ITR in 2026?

For AY 2026–27, a belated return may generally be filed on or before 31 December 2026 under Section 139(4) of the Income-tax Act, 1961, subject to the assessment-completion condition.

This applies to eligible taxpayers who missed their original filing deadline. The original due date depends on your category: salaried individuals using ITR-1 or ITR-2 generally had a 31 July deadline, while specified non-audit business cases had a 31 August deadline.

Taxpayers covered by the separate audit-category extension have a different original deadline. Check which category applies to you before treating your return as belated.

2. What is the late filing fee?

For AY 2026–27, the late filing fee under Section 234F is generally:

  • ₹1,000 where total income does not exceed ₹5 lakh.
  • ₹5,000 in other cases.

Interest or other tax amounts may also be payable, depending on your tax liability and circumstances. The filing fee is not necessarily the only amount you may owe.

3. What if you already filed your ITR but found a mistake?

If you filed your return but later discovered an omission or incorrect information, you may be able to file a revised return instead of a belated return.

For AY 2026–27, the revised-return deadline is generally 31 March 2027 or before completion of assessment, whichever is earlier. A fee may apply when filing a revised return after 31 December 2026. Review the latest portal requirements before submitting a correction.

4. Which documents should you prepare?

  • PAN and Aadhaar details, where applicable
  • Form 16, salary details or business income records
  • Bank statements and interest certificates
  • Form 26AS and Annual Information Statement (AIS)
  • Details of TDS, advance tax and other tax payments
  • Investment, capital gains and deduction records relevant to your return

Reconcile your income and tax-credit information before filing. If you have business income, capital gains, foreign income or several sources of income, check that the appropriate ITR form is used.

5. Does the new Income-tax Act apply to this return?

The Income-tax Act, 2025 came into effect on 1 April 2026. However, returns for income earned during FY 2025–26 are filed for AY 2026–27 under the Income-tax Act, 1961. The transition does not automatically move this return to the new Act.

Need help completing a pending ITR?

If you missed your filing deadline, are unsure about the applicable fee or need to correct a previously filed return, reviewing your position promptly can help you identify the right next step.
